FDA records show that seventeen patch users between the ages of 17 and 30 have suffered fatal heart attacks, blood clots and possible strokes since August 2002.
As of November 15, 2005, five lawsuits have been filed against Ortho-McNeil Pharmaceutical, Inc., the manufacturer of the Ortho Evra birth control patch. Ortho-McNeil is a wholly owned subsidiary of the giant corporation, Johnson & Johnson.
- On November 15, 2005 a suit was filed on Behalf of a 32-year-old wife and mother of two who died on July 30, 2005 from a severe pulmonary thrombosis. She had been using the Ortho Evra Patch for 11 Months and was reported to have been in good health.
- On November 3, 2005 a suit was filed on behalf of a 23-year-old who experienced multiple pulmonary embolisms after using the patch for 10 months. To save this victim's life, she underwent surgery called pulmonary thromboendarterectomy , which resulted in the dissection of chronic thromboembolic material from both lower lobe pulmonary arteries.
- Pulmonary embolism is caused by a loss of blood flow to the lungs. Blood clots, caused in this case by use of the patch, often form in the legs or pelvic vein before traveling to and lodging in the pulmonary arteries in the lungs. This condition can cause chest pain, difficulty breathing, fainting, anxiety and even convulsions and death.
- On September 2, 2005 a suit was filed on behalf of a 37 year old woman who suffered a pulmonary embolism. She had been using the patch for seven months.
- On July 26, 2005 a suit was filed on behalf of a 30-year-old wife and mother of four who developed life-threatening blood clots and bleeding in her brain after using the Ortho Evra Patch contraceptive patch for 7 months.
- On July 25, 2005 a suit was filed on behalf of 10 women aged 18 to 47 who suffered strokes and blood clots. All of the women, from 10 different states and areas of the country, now suffer from permanent crippling health problems. The suit seeks punitive damages of an undisclosed amount.
- All of the victims involved in these lawsuits suffered from injuries due to the complications caused by blood clots. Recent reports have indicated that the risk of developing blood clots, pulmonary embolism, heart attack and stroke may be significantly higher with the Ortho Evra patch than with oral contraceptive use.
It is alleged that Ortho-McNeil was aware of the increased medical risks associated with Ortho Evra Patch before the drug was approved and that, once approved, the company failed to adequately warn patients about these risks. Evidence shows that the risk of blood clots, heart attack and stroke associated with Ortho Evra Patch is significantly higher than with oral contraceptive pills. The incidence of embolisms and thrombotic injuries in Phase III trials of Ortho Evra Patch was reportedly six times greater than the incidence of such events in oral contraceptives using the hormone levonorgestral.
